Well Im making a box of cereal called MAX 300 Os, I wanted to sell it on ebay when I was done but I asked them if it was okay to sell (with konami things like spike pictures and the words "Max 300") They said they didnt know if it would be okay to list, and they said it was up to me..do you think that ill get in truble? You'll probably get in trouble...I don't know much about this sort of thing, but I think that making money off of something like that would be copyright infringement. though I'd buy a box...

Well of course you don't have the rights to Konami's games, logos, etc., but I don't think that Konami has the rights to the words 'Max 300', just the song. Exactly who did you ask? Ebay? No one will knock on your door and slap you with a lawsuit.

Why are you making "MAX 300 O's" cereal? Is it even edible?

To answer your question, I think you'd get in trouble. The backrounds are most likely copyright 1998-present Konami Computer Entertainment Tokyo (I'm being smart! E15.gif ) and I would violate the law to use their artwork on something you're selling.

EDIT: Beaten to it... copyright infringement.

edit: i'll also add that i think you'll be ok; if somebody wanted to ebay their child's crayon picture of super mario, for instance, it'd be fine... under i think what's called "parody" exclusion-- but i'm not a lawyer, but if it were me i wouldn't sweat it

This is by far the worst idea I've seen in years. Who the heck is going to eat cereal that goes 300 beats per minute and 450 beats per minute upside-down when you want to eat it after doing really well eating dinner?

Could you possibly get in trouble for it? Probably. But you can get in trouble for serving hot coffee to people who don't know that coffee is hot.

Will you? No. What are the chances that any of the companies will ever find out about this? And then what are the chances that they care enough to do anything? At most, they'd have it taken down.

Thats what I think..I would post it just to see if i do, but i think the worst they can do is just take it off ebay and give me a warning..do you think they would sue right off the bat?

Ebay does take their VeRO (copyright) policies very strictly though...
