I don't think they can since GH isn't that similiar to Guitar Freaks. |
It's about as similar as PIU is to DDR. |
I'm pretty sure Konami tried suing Andamiro a couple of years back... fortunately it didn't work.

If i'm not mistaken, Andamiro was impacted, and can't produce PIU in certain regions of the world.

The first PUI was released in October 1999. I can't find much specific information on the Konami / Andamiro lawsuit but both companies had restrictions placed on their locations and Andamiro paid Konami an unspecified amount of money in the settlement.
