No, you can't. You are distorting what the lawsuit was about, as pretty much everyone does. What you hear about that lawsuit is now purely propaganda because it differs so much from what really happened.

The reality is the plantiff sued for medical fees because the coffee was not just hot, it was heated to an excessive temperature (near boiling). When it spilled in her lap it caused severe damage due to scalding. The danger was that the coffee was heated so much, so that it could not even be drunk, and that if it spilled it could be extremely dangerous.

All she wanted was medical fees, which McDonalds refused to pay. So the lawsuit was filed and McDonalds lost and a ridiculous award was given to the plantiff by the jury. This extreme monetary award was later reduced by the judge on appeal, as almost all extreme awards are.

So, you see, the reality is not quite as black and white as the overly simplified talking point that we always hear about.

Hence why my example might or might not make good claim for prior art. Power Pad Dance Aerobics did have the same kind of concept did it not, or did I miss something? If so, my bad.

Was it to music and did the game rate you on how well you were on or offbeat? If not, then it's a different concept.

It is to music IIRC, and whether you do good, or bad depends on how on or off beat you are with the "instructor"'s steps.
