Am I wrong or is this guy selling what looks like DWI?

That's actually Stepmania. Other than that, you're right. Well, not exactly. It is legal for someone to sell Stepmania and whatever content is on the CD, provided that:

-They provide the full source code to their program with the program, and that the user is free to distribute and modify the source as they see fit (since Stepmania is under the GPL license)
-They own the rights to (or have procured licenses for) all of the content in the game.

Somehow, I doubt they fufilled point 1. Point 2 is an obvious copyright violation.
